Welcome to VÉLOURA. By accessing or using our website, mobile application, or any services provided through our platform, you agree to be bound by these Terms of Use.

1. The VÉLOURA Marketplace

• Marketplace Role: VÉLOURA Beauty On Demand is a technology marketplace that connects customers with independent beauty, wellness, and creative professionals.
• Independent Professionals: VÉLOURA does not itself perform beauty services. Professionals using the platform are independent service providers and are not employees, agents, or representatives of VÉLOURA.
• Variability: Specific services, professionals, pricing, and availability vary by location and are subject to change without notice.

2. Non-Medical Services Disclosure

• Cosmetic Purpose: VÉLOURA is intended for cosmetic beauty, grooming, wellness, and lifestyle services permitted on the platform.
• No Medical Treatment: VÉLOURA is not a healthcare or medical service provider. Services offered through the platform are not intended to diagnose, prevent, treat, or cure any disease, injury, or medical condition.
• Prohibited Procedures: VÉLOURA does not offer medical treatment, wound care, injections, or any medical-grade procedures.

3. Safety & The Broken Skin Rule

To ensure the safety of our community, a professional must not perform a beauty service on an area exhibiting any of the following conditions:

• Active bleeding, open wounds, or open sores.
• Visible infection, pus, or drainage.
• Exposed tissue or significant skin injury.
• Contagious skin conditions or significant unexplained inflammation.

A professional has the absolute right to refuse, modify, or stop a service if they reasonably believe it cannot be performed safely or legally. Professionals will not provide medical diagnoses.

4. Professional Licensing & Scope

• Authorization: The appearance of a service on VÉLOURA does not guarantee that every professional is legally authorized to perform that service in every jurisdiction.
• Responsibility: Professionals are solely responsible for maintaining the licenses, registrations, permits, certifications, and insurance required by applicable law for the services they provide.
• Restrictions: Certain services may be restricted or unavailable based on state law, local regulations, or professional license type (e.g., Cosmetology vs. Esthetics).

5. Prohibited Services

VÉLOURA strictly prohibits the use of its platform to arrange or provide procedures intended to:

• Intentionally penetrate or puncture living skin (e.g., microneedling, microblading).
• Intentionally cause bleeding.
• Inject any substance (e.g., fillers, Botox).
• Perform tattooing, permanent makeup, or body piercing.
• Treat medical conditions, infections, or wounds.

6. User Responsibilities

• Accuracy: You must provide accurate booking information, including the correct service location.
• Disclosure: You are responsible for informing the professional of any allergies, sensitivities, injuries, or previous product reactions relevant to the service.
• Location Safety: You must ensure the requested service location (home, hotel, office, etc.) is safe and appropriate for the appointment.
• Property Permission: You are responsible for obtaining any necessary permissions from property owners or management (e.g., hotel policies regarding outside vendors).

7. Payments, Cancellations & Refunds

• Secure Processing: Payments are processed securely through third-party providers (Stripe).
• Cancellation Fees: Cancellations made within 24 hours of an appointment may be subject to a cancellation fee as detailed in our Reliability Policy.
• No-Shows: If you are not present at the service location at the scheduled time, the full service fee will be charged to compensate the professional.

8. SMS & Communications Terms

By providing your phone number, you agree to receive service-related SMS messages, including booking confirmations, reminders, and support notifications. You may opt out at any time by replying STOP.

9. Results & Expectations

Beauty service results are subjective and vary based on individual circumstances, products, and techniques. Photos displayed on VÉLOURA are for illustrative purposes only and do not guarantee a specific outcome.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VÉLOURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE ACTS OR OMISSIONS OF INDEPENDENT PROFESSIONALS OR THE OUTCOME OF ANY BEAUTY SERVICE.

11. Intellectual Property

All content, software, logos, and trademarks on the platform are the property of VÉLOURA and may not be used, copied, or distributed without express written permission.

12. Governing Law

These Terms are governed by the laws of the United States and the State in which VÉLOURA operates, without regard to conflict of law principles.
